Welcome to Gotta’ Have It Artworks & Custom Framing (“GHIA,” “we,” “us,” or “our”). These Terms of Service govern your use of our website, www.gottahavitarts.com, and purchases made through Gotta’ Have It Artworks & Custom Framing.

By accessing our website, placing an order, purchasing merchandise, or using our services, you agree to these Terms of Service and the policies referenced within them.

1. General Terms

Gotta’ Have It Artworks & Custom Framing offers African American art, original artwork, limited and open editions, sculptures, collectibles, home décor, custom framing, and other merchandise.

We reserve the right to update, modify, discontinue, or change products, services, prices, website content, and these Terms of Service at any time, subject to applicable law.

2. Products & Artwork

We make reasonable efforts to accurately describe and display all artwork and merchandise offered for sale.

Because many of our products include original artwork, handcrafted items, sculptures, limited editions, vintage or previously released artwork, and other unique pieces, minor variations or characteristics may be present.

Colors, textures, finishes, dimensions, matting, mouldings, and other details may also appear differently on computer monitors, tablets, and mobile devices.

Room displays, lifestyle images, and digital mockups may be used to demonstrate how artwork could appear in a home, office, or other environment. Unless otherwise stated, these displays are for illustrative purposes and may not represent the exact scale or appearance of the artwork.

3. Original & One-of-a-Kind Artwork

Original artwork and certain sculptures or handcrafted pieces may be one-of-a-kind.

Placing an item in an online shopping cart does not necessarily reserve that item. An order is subject to acceptance and availability.

If an original or one-of-a-kind item is sold or otherwise unavailable before we can fulfill an order, we reserve the right to cancel the affected order and issue any refund required.

4. Pricing

All prices are listed in U.S. dollars unless otherwise stated.

We make reasonable efforts to ensure that pricing and product information are accurate. However, typographical, technical, or pricing errors may occasionally occur.

If an item is incorrectly priced or described, Gotta’ Have It Artworks & Custom Framing reserves the right, subject to applicable law, to correct the error and cancel or decline an affected order.

Applicable taxes, shipping charges, and other disclosed charges may be added to the purchase price.

5. Orders & Payment

By submitting an order, you represent that the information provided during checkout is complete and accurate and that you are authorized to use the payment method provided.

Submission of an order does not guarantee acceptance.

We reserve the right to decline or cancel an order when reasonably necessary, including because of product unavailability, suspected fraud, payment problems, incorrect pricing or product information, or circumstances preventing fulfillment.

If we cancel an order after payment has been collected, an appropriate refund will be issued.

6. Custom Framing

Custom framing is created according to the specifications selected or approved by the customer.

Customers are responsible for reviewing and approving applicable framing selections, which may include:

Moulding or frame style
Matting
Liners
Fillets
Glazing
Dimensions
Design and placement

Because custom framing is specifically produced for an individual customer, custom framing and specially ordered framing materials are final sale and are not eligible for return or refund, except where required by law or where an error was made by Gotta’ Have It Artworks & Custom Framing.

Natural variations in wood, finishes, fabric, matting, and other framing materials are not necessarily defects.

7. Shipping

Gotta’ Have It Artworks & Custom Framing currently utilizes USPS Priority Mail, UPS, and FedEx for shipping purchases.

The appropriate carrier may be selected based on the dimensions, weight, value, destination, and shipping requirements of the merchandise.

Once an order has shipped, customers will receive tracking information that can be used to monitor the shipment and estimated delivery date.

Carrier delivery dates are estimates and may be affected by weather, holidays, transportation interruptions, or circumstances outside our reasonable control.

Orders will be shipped within the timeframe communicated to the customer. Where no specific shipping timeframe has been provided, orders will be handled in accordance with applicable federal requirements.

If we are unable to ship within an applicable promised or legally required timeframe, we will provide notice and any cancellation/refund options required by applicable law.

8. Shipping Addresses

Customers are responsible for providing complete and accurate shipping information.

Gotta’ Have It Artworks & Custom Framing is not responsible for delays or additional expenses resulting from an incorrect or incomplete address provided by the customer, except to the extent otherwise required by law.

Once a package has been transferred to the shipping carrier, we cannot guarantee that an address can be changed or the shipment redirected.

9. Returns & Refunds

Eligible merchandise may be returned in accordance with our 7-Day Return & Refund Policy.

Customers have seven (7) calendar days from the date merchandise is received to request an eligible return.

The merchandise must be returned in the same condition and manner in which it was received, including applicable original packaging and protective materials.

Customers are responsible for return shipping costs unless otherwise stated or required by law.

Custom-framed, commissioned, personalized, altered, or special-order merchandise is generally final sale and is not eligible for return or refund except where required by law or where an error was made by Gotta’ Have It Artworks & Custom Framing.

10. Damaged Shipments

Customers should inspect merchandise promptly after delivery.

If merchandise arrives damaged, please contact Gotta’ Have It Artworks & Custom Framing within seven (7) days of delivery.

Customers may be asked to provide photographs of:

The damaged merchandise
The shipping box or container
Interior packaging materials
Shipping labels
Any visible damage to the exterior packaging

Please retain all packaging materials until the claim has been reviewed.

11. Artwork Copyright & Intellectual Property

Purchasing artwork does not automatically transfer copyright, reproduction rights, licensing rights, or other intellectual property rights associated with the artwork.

Copyright and other intellectual property rights in individual works remain with the respective artist, copyright holder, or lawful rights holder unless expressly transferred in writing.

Artwork images, photographs, graphics, product images, website content, logos, descriptions, and other protected materials may not be copied, reproduced, modified, distributed, published, sold, commercially exploited, or used for advertising without appropriate authorization.

12. Website Content

Content created and owned by Gotta’ Have It Artworks & Custom Framing, including our branding, original photography, written content, graphics, promotional materials, and website designs, may be protected under applicable intellectual property laws.

Nothing contained on this website grants a license or right to use our intellectual property or the intellectual property of artists or other third parties without permission from the applicable rights holder.

13. Third-Party Artists & Rights Holders

Gotta’ Have It Artworks & Custom Framing sells and promotes artwork from independent artists and other rights holders.

Artist names, artwork titles, signatures, images, trademarks, copyrights, and other intellectual property remain subject to the rights of their respective owners.

Our sale or display of an artist’s work should not be interpreted as transferring ownership of the artist’s intellectual property rights to the purchaser.

14. Website Use

You agree not to use our website:

For unlawful or fraudulent purposes
To interfere with the operation or security of the website
To attempt unauthorized access to website systems or customer information
To reproduce or commercially exploit protected content without authorization
To misrepresent your identity or payment information
To falsely represent an affiliation with Gotta’ Have It Artworks & Custom Framing

We reserve the right to restrict access to the website when reasonably necessary to protect our business, customers, artists, or website systems.

15. Third-Party Services

Our website may use or link to third-party services, including payment processors, shipping carriers, social media platforms, and other service providers.

Those third parties may operate under their own terms, conditions, and privacy policies.

Gotta’ Have It Artworks & Custom Framing is not responsible for the independent operation or content of third-party websites or services except as required by applicable law.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Gotta’ Have It Artworks & Custom Framing will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from the use or inability to use our website, products, or services.

Nothing in these Terms is intended to eliminate or restrict any consumer right, warranty, remedy, or liability that cannot legally be waived or limited.

17. Governing Law

These Terms of Service shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict-of-law principles, except where applicable federal law or other mandatory law provides otherwise.

18. Changes to These Terms

We reserve the right to revise these Terms of Service from time to time.

Updated Terms will be posted on our website with a revised effective date. Your continued use of the website after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

19. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

20. Entire Agreement

These Terms of Service, together with our applicable Shipping Policy, Return & Refund Policy, Privacy Policy, and Legal Notice, constitute the terms governing use of our website and purchases from Gotta’ Have It Artworks & Custom Framing, except where separate written terms have been agreed upon.
